By accessing this website or hiring our services, you agree to the following legally binding terms.


1. ACCEPTANCE OF TERMS

By requesting service, signing an estimate, approving work verbally, submitting payment, or allowing work to begin, you agree to these Terms in full.

If you do not agree, do not use this website or our services.


2. ESTIMATES & SCOPE OF WORK

• All estimates are based on visible and reasonably accessible conditions at the time of inspection.
• Plumbing systems may contain hidden damage, code violations, corrosion, structural deterioration, or improper prior work not visible at time of estimate.
• Additional charges may apply if hidden conditions are discovered.

We reserve the right to adjust pricing if:

No estimate guarantees final cost unless specifically stated in writing as “fixed price.”

3. LIMITATION OF LIABILITY (VERY IMPORTANT)

To the maximum extent allowed under Georgia law:

Shanks Onsite Services, LLC shall NOT be liable for:

• Pre-existing plumbing failures
• Corrosion, deterioration, or weakened piping
• Hidden leaks
• Mold or mildew
• Structural damage
• Sheetrock or cosmetic damage
• Flooring damage
• Water damage from prior system failure
• Delays caused by parts suppliers
• Manufacturer defects
• Product recalls
• Acts of God
• Power outages
• Municipal water pressure issues

Our total liability for any claim shall NEVER exceed the amount paid for the specific service performed.

Under no circumstances shall we be liable for:

• Consequential damages
• Incidental damages
• Lost profits
• Business interruption
• Emotional distress
• Secondary property damage

4. NO GUARANTEE OF SYSTEM INTEGRITY

When replacing a water heater, PRV, shut-off valve, or any component:

We do NOT guarantee the integrity of the remaining plumbing system.

Older plumbing systems may fail after new installations due to:

• Increased pressure
• Thermal expansion
• Disturbance of old fittings
• Age-related deterioration

We are not responsible for failures of unrelated components.


5. WATER DAMAGE DISCLAIMER

Customer acknowledges that plumbing systems involve pressurized water.

Even with proper installation:

• Leaks may occur
• Seals may fail
• Manufacturer defects may exist

Customer assumes responsibility for monitoring new installations.

We are not responsible for damage caused by:

• Failure to monitor
• Failure to maintain
• Failure to repair unrelated plumbing components

6. WARRANTY DISCLAIMER

We provide workmanship warranties only if stated in writing.

Manufacturer warranties apply solely through the manufacturer.

We do NOT warrant:

• Pre-existing systems
• Drain lines
• Old piping
• Fixtures not replaced
• Customer-supplied materials

Improper use, neglect, freezing, pressure fluctuations, and chemical corrosion void all warranties.


7. PAYMENT TERMS

Payment is due upon completion of service unless otherwise agreed in writing.

Failure to pay may result in:

• Late fees
• Collection actions
• Filing of a mechanic’s lien as permitted by Georgia law
• Recovery of legal fees

Returned checks are subject to fees.

Chargebacks without written dispute resolution may result in collection action.

8. CREDIT CARD & DATA SECURITY

We use third-party processors (including Wave and its partners) to process payments.

We do not store full credit card numbers on our website.

Customer acknowledges:

• Electronic systems may be vulnerable to unauthorized access
• No system is 100% secure
• We are not liable for third-party cyberattacks outside our direct control

9. DATA PRIVACY

We collect:

• Name
• Phone number
• Email
• Service address
• Payment data (processed by third-party providers)

We use data solely to:

• Provide services
• Communicate
• Invoice
• Maintain records

We do not sell personal information.

10. SMS & COMMUNICATION CONSENT

By providing your phone number, you consent to receive:

• Service-related calls
• Appointment confirmations
• Invoice notifications
• Service updates

Message and data rates may apply.

We do not send marketing campaigns without consent.


11. WEBSITE DISCLAIMER

12. INDEMNIFICATION

Customer agrees to indemnify and hold harmless Shanks Onsite Services, LLC from any claims arising from:

• Pre-existing plumbing conditions
• Customer modifications
• Third-party contractor interference
• Improper system maintenance
• Customer negligence


13. FORCE MAJEURE

We are not liable for failure or delay due to:

• Weather
• Natural disasters
• Supply chain shortages
• Government orders
• Illness
• Accidents
• Events beyond reasonable control


14. DISPUTE RESOLUTION

All disputes shall be resolved under Georgia law.

Venue shall be within the State of Georgia.

Customer agrees to attempt good-faith resolution before litigation.

15. SEVERABILITY

If any portion of these Terms is deemed unenforceable, the remaining provisions remain in full force.


16. ENTIRE AGREEMENT

These Terms constitute the entire agreement between customer and Company and supersede prior verbal statements.


17. MECHANIC’S & MATERIALMAN’S LIEN RIGHTS (GEORGIA)

Pursuant to O.C.G.A. § 44-14-361 et seq., Shanks Onsite Services, LLC reserves all rights to file a mechanic’s and materialman’s lien for unpaid labor, services, and materials provided.

Customer acknowledges:

• Failure to pay for services may result in a lien against the property.
• A lien may affect title, refinancing, or sale of the property.
• Customer is responsible for all costs associated with enforcing lien rights.

Nothing herein constitutes a waiver of lien rights unless provided in writing after full payment.


18. PAYMENT DEFAULT & COLLECTION COSTS

If payment is not received when due:

• A late fee may be applied.
• Interest may accrue at the maximum rate permitted under Georgia law.
• The account may be referred to collections.

Customer agrees to pay:

• Collection agency fees
• Attorney’s fees
• Court costs
• Filing fees
• Lien recording costs
• Administrative costs

To the fullest extent permitted by law.

19. ARBITRATION AGREEMENT

Any dispute arising from services provided shall be resolved by binding arbitration in the State of Georgia, in accordance with the rules of the American Arbitration Association.

Customer waives the right to:

• Jury trial
• Class action participation
• Consolidated claims

Each party shall bear its own attorney’s fees unless otherwise awarded by the arbitrator.

20. ATTORNEY’S FEES

In any action to enforce these Terms, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs as permitted by Georgia law.

21. PERSONAL RESPONSIBILITY OF PROPERTY OWNER

The person requesting service represents that they are:

• The property owner, OR
• Authorized by the property owner to approve work and payment

If the requesting party is a tenant or agent, they agree to remain personally responsible for payment unless prior written agreement states otherwise.


22. WAIVER OF CONSEQUENTIAL DAMAGES

Customer expressly waives claims for:

• Loss of use
• Rental loss
• Business interruption
• Secondary property damage
• Mold claims
• Insurance disputes

Unless directly caused by gross negligence or willful misconduct.


23. NO VERBAL MODIFICATIONS

No verbal statements, representations, or assurances by employees or representatives shall modify these Terms unless in writing and signed by an authorized representative of Shanks Onsite Services, LLC.


24. RECORDING & DOCUMENTATION

Company reserves the right to:

• Photograph work areas
• Document job conditions
• Retain job records

For protection, quality control, and legal defense.

Photos will not be used publicly without customer consent.

25. INSURANCE DISCLAIMER

Customer acknowledges that:

• Homeowner’s insurance claims are between customer and their insurer.
• We are not responsible for insurance approvals or denials.
• We do not guarantee reimbursement.


26. SEVERABILITY & SURVIVAL

If any provision is held unenforceable, the remaining provisions remain valid.

Provisions relating to liability, payment, indemnification, arbitration, and attorney’s fees survive completion of work.
